1. Acceptance of Terms

By accessing or using Fively ("the Service"), you agree to be bound by these Terms & Conditions. Fively is a product of Tooldee, a brand of Markedee Technologies Pvt. Ltd. (CIN: U58202UP2026PTC248520, GSTIN: 09AAVCM0151C1ZJ), Bareilly, Uttar Pradesh, India. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Fively helps businesses invite their customers to share feedback and post Google reviews, using QR codes and review links. Customers can get an optional AI-suggested draft, which they edit into their own words and post themselves on Google. Unhappy customers can also send private feedback to the business, and every customer can choose to post on Google. The Service also includes listing management, analytics, and — on eligible plans — Google Business Profile integration for viewing and replying to the business's own reviews.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may not maintain more than one free account.

4. Plans and Billing

  • Fively offers a free plan and paid plans (Starter, Pro, Agency) with different feature limits.
  • Paid plans are billed monthly. Prices are in Indian Rupees (INR) and inclusive of applicable taxes.
  • Plan limits (listings, AI generations) reset on the 1st of each calendar month.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to use Fively to:

  • Create, post, or ask anyone to post fake or misleading reviews — including reviews by yourself, your staff, or anyone who has not genuinely used your business.
  • Offer customers money, discounts, gifts, or other rewards in exchange for reviews.
  • Stop or discourage customers from posting negative reviews, or ask only happy customers to review.
  • Violate Google's review and content policies, the Google Business Profile guidelines, or any applicable law, including Indian consumer protection law.
  • Spam, harass, or harm other users or third parties.
  • Attempt to reverse-engineer, scrape, or exploit the platform.
  • Use the Service for any illegal purpose.

Violation of these rules may result in immediate account suspension without refund.

6. AI-Generated Content

Fively uses AI (Anthropic Claude) to suggest review drafts for customers and reply drafts for businesses. You acknowledge that:

  • AI drafts are suggestions only. Customers decide what to write and post their own reviews on Google; Fively never posts reviews on anyone's behalf.
  • Businesses are responsible for replies published from their account, including replies published automatically when auto-reply is turned on.
  • AI output can be inaccurate. We do not guarantee its accuracy or quality, so please review drafts before using them.

7. Intellectual Property

The Fively platform, branding, and code are owned by Markedee Technologies Pvt. Ltd. Your business data, logos, and review content remain yours. You grant us a limited licence to process your data solely to provide the Service.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will result in improved Google rankings or review counts.

9. Limitation of Liability

To the maximum extent permitted by law, Markedee Technologies Pvt. Ltd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of Fively. Our total liability shall not exceed the amount paid by you in the last 3 months.

10. Termination

You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bareilly, Uttar Pradesh, India.
